Ganguly and Shah continue to bat at BCCI till end of January
The Annual General Body Meeting (AGM) of Board of Cricket Control in India (BCCI) to be held on December 24, 2020 will have Ganguly, Shah and George presiding over the engagements. Their term has gotten over and they still sit in the chairs causing lots of raised eyebrows in BCCI. RM Lodha Committee appointed by BCCI's Committee of Administrators spent years correcting the irregularities of BCCI regulations and had suggested a Supreme Court-mandated constitution on August 21, 2018. But post election of Ganguly and Shah's team in October 2019, they have still not implemented the constitution, indirectly disobeying direct orders of Supreme Court.
The terms of engagement
BCCI earlier had knocked the door of supreme court with amends to the constitutions to ensure the Ganguly and Shah at the management crease for longer. The hearing in the court has been constantly being postponed for the third time now since postponements in July and May, 2020. But the new constitution raised alarms in the state associations and also in BCCI, this led to them reaching Supreme Court with their set of objections related to the new statute.
The Amicus Curiae
Hearing to their plea the Supreme Court instated Mr. PS Narasimha as the acting amicus curiae (a friend to the court) as a mediator to sort and counsel some of the difference between the two parties. His recommendations post his research and findings were to classify and catalogue different Interlocutory Applications with respect to BCCI, in a pre construed steady manner. He also suggested that 25 Interlocutory Applications could be gotten rid off with pre described solution. 35 other ineffective Interlocutory Applications which can be removed and he mediated 25 more effectively to the benefit of both parties. There are 14 Interlocutory Applications that are being contended needs modifications/ clarifications which would be addressed when the Supreme Court comes back to work post the winter vacations starting from December 18, 2020.
Speaking to the media Mr. Amicus Curiae mentioned "Court has disposed majority of queries raised for discussion and maximum of those were not found to be worthy of court's time. We have successfully mediated cases like Karnataka where with effective mediation we have successfully have held elections. There are few cases remaining to be discussed which would come back to discussion in third week of January. The application of BCCI for amendments to constitution would not happen today".
